A case regarding deprivation of inheritance of women has been decided

The Balochistan High Court, while ruling in a case of deprivation of women's right to inheritance, said that a person who deprives a woman of movable and immovable property will be sentenced to a minimum of 5 years and a maximum of 10 years imprisonment. A fine of Rs 10 lakh will also have to be paid.

A two-member bench comprising Chief Justice Balochistan High Court Justice Jamal Khan Mandokhel and Justice Muhammad Kamran Khan Malakhel heard the petition filed by advocate Muhammad Sajid Tareen regarding women's right to inheritance and neglect in the ongoing settlement process in the province. Decided.

The court held that the criminal law of the Pakistan Penal Code has been amended by section 498A to reduce issues such as deprivation of inheritance rights to women, according to which section 498A deprives any woman of the right to property. Prevents deprivation.

The Chief Justice said that anyone who deprives a woman of movable and immovable property at the time of fraud or illegal death is liable to imprisonment for a term not exceeding 10 years and not less than 5 years. Will not be less than or 1 million fine or both will be given.

He said that the strategy in amending this section was to ensure that no woman was deprived of her right to inheritance. Criminal action against violators is certainly a good omen, but not for men. In a dominant society, it is not easy for a woman to go to the police station and file a criminal case against her male family member.

The court said that in this case, the government should take responsibility for the distribution of the deceased's property to the heirs and punish the violators, while the print and electronic media for social awareness and especially the scholars and scholars should be made aware of the campaign. Participate so that they create awareness not only among women but also among men about the legitimate rights of the deceased's property in accordance with Islamic injunctions.

The Balochistan High Court further said that men's ignorance of Islamic injunctions also deserves attention as Islamic principles and injunctions are not taught regularly. Concerning women's rights, upgrade the curriculum by including them in the curriculum at the level of schools, colleges and universities.
